Terms of Service

The short version
Refstay gives hosts a personal referral link. When guests use the link and book Miami activities, hosts earn 5% commission, paid monthly. To stay in good standing, don't spam, don't fake bookings, and don't break local laws. We can change the commission rate with 30 days' notice. Either side can end the relationship anytime.
1. Who can use Refstay
You can sign up as a host if:
- You're 18 or older
- You operate a short-term rental in Miami, FL or Punta Cana, Dominican Republic (other zones may be added later)
- You agree to these Terms and our Privacy Policy
- You're not on a sanctions list or otherwise prohibited from doing business with US-based companies
2. How the commission works
Commission rate
You earn 5% of the booking total (excluding taxes and fees) for any Miami activity your guest books through your personal referral link. We can change this rate with 30 days' written notice; bookings made before the change use the old rate.
Attribution
A booking is attributed to you when:
- Your guest clicks your
refstay.com/r/yourslug link
- They complete a paid booking at an activity operator we list (currently 538 operators across Miami and Punta Cana)
- FareHarbor records your slug in the booking reference
- The booking is not canceled, refunded, or charged back
Payouts
- Paid monthly by the 15th, for the prior month's confirmed bookings
- Minimum payout: $25. Balances under $25 roll over.
- Payment via PayPal or Zelle (you choose in your dashboard)
- If we can't reach you and a payout is pending for 12 months, the balance is forfeited
What's NOT included
- Bookings made directly with operators outside Refstay
- Self-bookings (e.g., you booking your own activities)
- Bookings that get refunded — we deduct refunded commissions from your balance
- Booking modifications that lower the total — commission adjusts accordingly
3. What you agree NOT to do
- Share your link via spam, paid ads, or in ways that violate Airbnb/VRBO/etc terms
- Mass-message or solicit unrelated to your hosting (your link is for YOUR guests)
- Misrepresent Refstay or the listed operators
- Attempt to scrape, reverse-engineer, or attack our systems
- Create multiple accounts to bypass payout minimums
- Use copyrighted material (Refstay logo, operator branding) without permission outside the provided print assets
Violation may result in suspension, forfeiture of pending commissions, and/or legal action.
4. What we DO provide
- A personal referral link + dashboard
- Printable welcome cards, fridge magnets, wall posters, and welcome-book inserts personalized with your QR code
- Direct booking links pre-tagged with your referral code for 538+ Miami/Punta Cana activity operators
- Monthly commission reports + payouts

5. What we DON'T guarantee
- Number of bookings or commissions — that depends on you sharing your link
- Specific activity operators staying on the platform — operators come and go
- Uninterrupted service — we use Vercel + Supabase which have ~99.9% uptime, not 100%
- Tax advice — your commissions are taxable income. We'll send a 1099 if you earn $600+/year (US hosts).
6. Termination
You can delete your account anytime (email support@refstay.com). Pending confirmed commissions are paid out within 60 days. After deletion, your referral link becomes inactive — future bookings via that link aren't credited.
We can suspend or terminate your account if you violate these Terms, with notice via email when possible.
7. Disputes
First, try emailing us — most issues resolve in 1-2 days. If we can't agree, disputes are resolved by binding arbitration in Miami-Dade County, FL, under Florida law. You waive class-action rights.
8. Limitation of liability
Refstay is provided "as is". We're not liable for:
- The actions or quality of activity operators (they have their own terms with your guests)
- Lost commissions due to FareHarbor outages or attribution errors beyond our control
- Indirect damages (lost profits, business interruption, etc.)
Maximum liability: the total commissions we've paid you in the prior 12 months. Some jurisdictions don't allow these limits, so they may not apply to you.
9. Changes to these Terms
We'll notify you via email + a dashboard banner of material changes. Continued use after notice = acceptance. If you don't agree, delete your account before the changes take effect.
